Terms of service

These are the terms between you and EAP Media, the business name of Peter Zhang, who runs it on his own in Ontario, Canada, when you use eapmedia.org, the free website test or the onboarding questions. They're written to be read, not skimmed. If a sentence isn't clear, ask us and we'll explain it.

What we do

We build a simple, fast website for your business for one flat price, then host it and look after it for a small monthly fee. You tell us about your business, we design the site, you see a preview, ask for changes, approve it, and we launch it. The current prices are on our homepage, and the price you see when you sign up is the one you pay.

What we promise, and what we don't

  • We'll build the site around your answers, show you a preview before launch, and make the changes you ask for before you approve it. Two rounds of changes are included with the build. If you need more, we'll tell you what it costs before we start.
  • On a plan with unlimited changes, “changes” means updates to the pages you have: text, photos, hours, prices and small layout tweaks. New pages, a redesign or new features are quoted separately.
  • We'll keep your site online and fix problems with it. We don't promise a specific uptime, because hosting and the internet are partly out of our hands.
  • We don't promise business results: traffic, leads, sales or search rankings.
  • Sending a request by email doesn't by itself add paid work. If something you ask for costs extra, we'll tell you first, and you decide.
  • The free website test runs on Google's PageSpeed Insights service. It's rate-limited and comes with no promise of accuracy or availability.

Your materials

“Your materials” means everything you give us for your site: text, answers, photos, your logo, reviews, and anything you upload or paste in. They stay yours.

  • You confirm you own them, or have permission to use them. That includes the people who appear in your photos, any photographer or designer who made them, and the writers of any reviews or quotes.
  • You let us use them for your site. You give us permission to copy, resize, crop, re-encode and edit your materials, and to use them to design, build, host, back up and show your website, for as long as we run it.
  • Showing our work. We may show your finished site, with your business name, as an example of our work on eapmedia.org. Tell us at any time if you'd rather we didn't, and we'll take it down.
  • We won't use your materials for anything else, and we won't sell them.

Who owns the finished site

You own your content: your words, photos, logo, reviews and your domain name. Once the build fee is paid in full, you also own the design we made for you: the look, the layout and the pages of your site. We keep our templates, tools and reusable code, and you have our permission to keep using them in your site for as long as it exists, including if you move it to another host. If you leave, you get your content, your domain and, where we can, a copy of your pages as files.

Paying us

  • The build fee is due before work starts. Monthly plans are billed in advance, month to month, with no long-term commitment.
  • Payments go through Stripe. We never see your full card number. Stripe emails you a receipt for every payment, and we'll send you a link to your billing page any time you ask.
  • Your invoice shows what you pay.
  • If a payment fails, we'll email you. If it's still unpaid after 14 days we pause your site, and after 30 days we take it down. Pay, and it comes back up.
  • If you cancel before we start work, we refund the build fee in full. If you cancel after we start but before you've seen a preview, we refund half. Once we've sent you a preview, the build fee isn't refunded. Monthly hosting isn't refunded for part of a month.
  • If we change a price, we'll email you 30 days before it applies to you.

If you leave

  • Cancel any time by email. Your site stays up through the end of the month you've paid for, unless you ask us to take it down sooner.
  • You keep your content and your domain name. Email us before you cancel if you'd like help moving them.
  • We keep your materials for 12 months after we stop working together, then delete them. Ask at any time in that year and we'll send you a copy of your materials and, where we can, a copy of your pages as files, within 30 days. Ask as you leave and we delete everything the same day instead. The details are in our privacy policy.

Using the site and the tools fairly

You agree not to:

  • give us material that is illegal, that you don't have the rights to, or that is meant to deceive people, including fake reviews;
  • use your site or your private link to send spam or to host malware, scams or anything that harms other people;
  • try to break into our systems, read another client's information, or get around rate limits;
  • use the free website test to hammer a site that isn't yours, or to run automated tests against it.

We can refuse material, take down content, pause a site or switch off a private link when these are broken. Where we can, we'll tell you first.

Limits of our responsibility

Our site and the free test are provided as they are. We'll fix problems with your site, but to the extent the law allows, we're not responsible for indirect losses, such as lost sales, lost data or lost time, and our total responsibility to you is capped at what you've paid us in the 12 months before the problem. Nothing in these terms takes away rights the law gives you that can't be waived.

Which law applies

These terms follow the laws of Ontario, Canada, and any dispute about them is heard in Ontario's courts, wherever you are. Before anything formal, talk to us first: email us and we'll try to sort it out within 30 days.

Changes to these terms

We can change these terms. When we do, we'll update the date at the top, and we'll email clients 30 days before a change that affects them takes effect. If you keep using our services after that, you accept the new terms. If you don't want to, you can cancel as described above.
